You would think that a personal-injury law firm would be sensitive to a client?s need for a service dog, but apparently attorneys at the firm of Larkin, Axelrod, Ingrassia & Tetenbaum are unfamiliar with Title III of the ADA.

The problems began when Lauren Klejmont hired the firm to pursue a personal-injury lawsuit. Klejmont has seizures, balance problems and memory trouble as a result of a spine and head injury. She also has limited motor function and uses a cane and leg brace. Her service dog, Reicha, picks things up and carries them for Klejmont, and helps her stand up when she falls. The dog also detects oncoming seizures.

In January 2009, Klejmont and Reicha went to the firm?s Newburgh office to meet with attorney John Ingrassia and other lawyers to discuss her case.

According to a suit Klejmont filed against the firm, the attorneys would not allow Reicha into Ingrassia?s office because he is allergic to dogs. Klejmont suggested meeting in a conference room, but the firm in??sisted the dog could not be present.

Klejmont left and sent a letter complaining of her treatment. The firm offered to meet her in the firm?s parking lot as long as the dog stayed in her car. She rejected the offer and filed suit alleging the firm illegally barred a service dog in violation of the ADA.

The firm is offering no comment.

Note: The ADA requires all public accommodations to be open to service dogs. It seems this problem could have been easily avoided by having Ingrassia speak to Klejmont by intercom from his office to the conference room.

The point is that businesses must be flexible and creative in solving accessibility problems before they be??come contentious?or spawn lawsuits.

As promised, now we turn to the crazy, twitterific fast, faster, ludicrous-speed world we live in, and what it means for those in the arts and entertainment field trying desperately to keep up with it all.


Now that I've wrapped up and submitted my?flash fiction story?and that's all done and behind me for now, I'd like to turn my attention to this brave new world of micro-stories and tweeted news articles and the like in this instant communication age we live in which seems to pick up speed every which way we turn. I do have a few more thoughts on the whole ?Instagrata? society we seem to be immersed in these days which, the more I see and hear, turns out to be something that has been around for a while, from the rise of pulp stories and short magazine articles in modern culture to radio and television which all seem hell bent on shoving as much story at us in as little time as possible to make room for more commercials, but this phenomenon has reached a new level of insanity thanks to the internets.?Head over to the YouTube stats?page for a second and try to wrap your head around some of those staggering statistics. Three billion video views per day, more video uploaded in a month than the three major networks put out in sixty years, 48 hours of video uploaded every minute. The numbers are indeed staggering, but wait.


What does all this mean in terms of how much actual time people devote to enjoying each of those offerings? I must admit, that sort of statistic was far more difficult to find in a casual internet search, but it has certainly piqued my curiosity. They'll never say, apparently, but how often do people switch to the next bit of infotainment? A few minutes? Less than a minute? Given the stats above, not to mention YouTube's usual 10 minute limit for uploads, it's not hard to imagine that the virtual remote control gets quite a workout.

Considering those stats (and what I've extrapolated, hopefully with a modicum of reason and logic), is it me or is this ?instant entertainment? thing getting somewhat out of hand? I mean, seriously, does every single popular video have to be 45 seconds or less? I blame Twitter. I dunno about Twitter, maybe I'm just showing my age but I'm sort of reaching my ?hold yer horses!? point with this whole deal. Tell your story in 30 seconds or less, or I don't have the attention span to bother with you!?

But anyway, yeah. Flash Fiction is interesting. It's obviously not a product of the internet per se (many flash fiction websites illustrate this by pointing out the famous?six word story?supposedly attributable to Ernest Hemmingway). And at least it forces you to really think about what you want to write and prioritize every word. Brevity can be useful, even important, I can't argue that point too much. And personally the super short story was intriguing enough a writing challenge to motivate me towards write something I wouldn't normally attempt and then even go so far as to submit it and see if I could get it published online. For the time it takes to write something that short it was definitely worth trying it on for size just for the fun of it.

In any case, as far as instagrata is concerned it certainly appears that it is here to stay. There are some areas of push-back, for instance the notion of 'slow food' and people getting away from the drive-through, grab-and-go eating culture that seems to be losing some of the popularity it enjoyed for some several decades at least. But in terms of entertainment, information gathering, 24 hour news, and more generally the overall way in which we view and interact with all these sources of infotainment that are brought into our homes, ideas such as Flash Fiction seem to be settling in for the long haul.

Fiat profit doubles in 2011 thanks to Chrysler (AP)

MILAN ? Fiat Group SpA, the Italian automaker which controls Chrysler, on Wednesday reported that full-year earnings more than doubled ? beating expectations ? thanks to Chrysler, which posted its first profit since 1997.

The net profit, attributable to the parent company, rose to euro1.3 billion ($1.71 billion) from euro520 million a year earlier, while revenue rose 66 percent to euro59.5 billion.

The results exceeded the company's guidance. The trading profit ? or earnings before interest, taxes and one-time items ? was euro2.3 billion ($3.03 billion), compared with the target of more than euro2.1 billion ($2.77 billion).

Shares in the company rose 6 percent to euro4.86 in Milan after the publication of the results.

In a call with Chrysler analysts, Fiat and Chrysler CEO Sergio Marchionne said that all of Fiat's net income came from Chrysler last year.

Fiat Group Autos, which comprises the Fiat, Lancia and Alfa Romeo brands, saw annual vehicle shipments slip 2.4 percent to 2 million, due largely to declining European sales, whereas Chrysler sales jumped 22 percent.

Marchionne has been trying to make Fiat plants more efficient, demanding new work rules in several sites in Italy. He has cited Fiat's inward-looking business model as a main cause of losses in the early 2000s, before he was brought in to turn it around.

"Somebody better get off their butts and snap on to the grid. We're not pulling the cart here," Marchionne said. "Being European doesn't entitle them to be economically inefficient."

Fiat, which controls 58.5 percent of Chrysler LLC, has consolidated results with the U.S. automaker since June. Without Chrysler, Fiat said it broke even for the year.

Chrysler sold 1.85 million vehicles last year, thanks to higher demand for Jeeps and revamped model lines under the Fiat partnership.

Fiat is counting on the U.S. company's continued strength. It forecast 2012 revenues of euro77 billion and net profit of euro1.2 to euro1.5 billion.

In the fourth quarter, Fiat's net profit attributable to the parent was euro43 million, down from euro139 million a year earlier, reflecting its less-than-full control of Chrysler and Ferrari, at 90 percent.

Quarterly revenue more than doubled to euro19.6 billion, but was flat without Chrysler's contribution.

In Fiat Group Autos, an increase of light commercial vehicle volumes failed to offset lower passenger car shipments, which declined 4.6 percent to 1.6 million, as demand in Fiat's domestic Italian market shrank significantly. Demand grew in Brazil, however, by 1.5 percent to 772,700 vehicles.

Ferrari, however, hit a record volume of 7,195 vehicles, a 10 percent increase over 2011, driven by sales of 12-cylinder models. Revenues at Ferrari rose 17 percent to euro2.25 billion, while Maserati revenues hit euro588 million on volumes of 6,159 vehicles.

Net industrial debt, which stood at euro5.5 billion at the end of 2011, is forecast to remain flat or grow to euro6 billion.

Fiat has proposed a dividend to preference and savings classes of shareholders, not to ordinary shareholders.
